As a tenant in UP, you have the right to: (1) Receive a written rent receipt for every payment, (2) A minimum 30-day notice before eviction (unless lease violation), (3) Refund of security deposit within 30 days of vacating (after deductions for genuine damages), (4) Uninterrupted access to essential utilities during the tenancy period. The UP Rent Control Act and The Model Tenancy Act 2021 both govern these rights.
No. Under standard tenancy law, a landlord must give advance notice (typically 24 hours) before entering the rented premises, except in genuine emergency situations (fire, flooding, etc.). Your right to peaceful enjoyment of the rented property is protected throughout the tenancy period.
A landlord can legally deduct from your deposit for: unpaid rent, unpaid utility bills, and genuine physical damage to the property beyond normal wear and tear. They cannot deduct for: normal wear and tear, pre-existing damage at move-in (document this with photos), or any improvements you made. Always do a walk-through inspection with the owner at move-out and get a written confirmation.
